TERMS AND CONDITIONS

 

DEFINITIONS

1. **"TBBT"** refers to The Bath Boat Trip.
2. **"HIRER"** refers to the individual or entity initiating contact with TBBT for the purpose of booking the Charter.
3. **"BOAT"** refers to the motor vessel Princess Cassia, owned and operated by TBBT.
4. **"CHARTER"** refers to the excursion or boat trip booked by the Hirer with TBBT.
5. **"HIRE CHARGE"** refers to the fee charged by TBBT to the Hirer for the Charter.
6. **"BOATMASTER"** refers to the individual appointed by TBBT as the representative and responsible operator on the Charter.
7. **"PASSENGER"** refers to any person, including the Hirer, who participates in the Charter.
8. **"ENTERTAINMENT CHARGE"** refers to any charge for food, drink, and other entertainment as requested by the Hirer and supplied by TBBT.

CONFIRMATION OF BOOKING

1. A booking is confirmed upon receipt of the required deposit or full payment, as applicable. By receiving this confirmation, the Hirer agrees to all terms and conditions stated herein.

 CANCELLATION BY THE HIRER

1. If the Hirer wishes to cancel the Charter, no refund will be provided unless TBBT can resell the Charter to another party. If the Charter is resold, an administration fee of £100 will be deducted from the refund.

2. If cancellation occurs within 28 days of the scheduled Charter date, the full charter amount is payable, regardless of whether payment has already been received. The Hirer is liable for this amount immediately upon cancellation.

CANCELLATION BY TBBT

1. TBBT reserves the right to cancel the Charter due to unforeseen circumstances or reasons beyond its control. In such cases, any monies paid by the Hirer will be refunded in full. TBBT shall not be liable for any further claims or consequential losses incurred by the Hirer.

CANCELLATION DUE TO FORCE MAJEURE

1. In the event of force majeure events (including but not limited to war, strikes, pandemics (COVID), or acts of God), TBBT reserves the right to postpone the Charter to a mutually agreeable date and time.

2. No refunds will be provided in force majeure situations. The Hirer agrees to reschedule the Charter based on TBBT's availability. It is the Hirer’s responsibility to obtain appropriate insurance coverage.

ALTERATION OF CHARTER COURSE

1. TBBT reserves the right to alter the course or itinerary of the Charter at the sole discretion of the Boatmaster, for reasons including but not limited to safety, weather conditions, or operational requirements.

RISK AND LIABILITY

1. Passengers participate in the Charter at their own risk. While TBBT takes reasonable precautions, it is not liable for any loss, injury, damage, or costs sustained by Passengers or any loss or damage to their personal belongings.

2. The Hirer agrees to indemnify and hold TBBT harmless from any claims, losses, liabilities, or expenses (including legal fees) arising out of or in connection with the Charter.

NO REFUNDS FOR DISSATISFACTION

1. No refunds will be provided if the Hirer or any third party is dissatisfied with the Charter, regardless of the reasons for their dissatisfaction.

PAYMENT

1. The Hirer must pay a deposit upon making the reservation. The balance of the Charter fee is due 28 days before the scheduled Charter date. Once paid, no refunds will be provided for any reduction in guest numbers.

2. Any additional charges, including Hire Charges or Entertainment Charges, must be paid before the Charter's departure. An invoice will be issued post-Charter if requested.

3. In the event of overpayment, the excess amount will be refunded to the Hirer following the Charter, along with the final invoice.

4. Any outstanding payments must be settled within 28 days of the Charter date. Failure to do so will result in TBBT charging interest on the outstanding amount at a rate of 4% above the current Bank of England minimum lending rate.

ENTIRE AGREEMENT

1. These terms and conditions constitute the entire agreement between TBBT and the Hirer and supersede all prior agreements, understandings, and arrangements, whether oral or written.

2. Any modification or waiver of these terms must be in writing and signed by both parties. This agreement shall be governed by the laws of the United Kingdom, and any disputes will be subject to the exclusive jurisdiction of the UK courts.
